Shelley Lubben Trying To Retract Declaration Made Under Penalty of Perjury

Remember remember the fifth of November...


Last year, as they worked out their divorce settlement between them, Garrett Lubben told Shelley he had decided to give Shelley well over $500k in assets. The house, the cars, tools -- basically, everything at the Springville property Shelley calls the 'Lubben Ranch'.

Garrett's intention, he says, was for he and his daughters to sever all ties in order to "start over with minimal memories remaining and zero spousal support." A new life, without Shelley.

Garrett also asked Shelley to do the right thing: to come clean to the authorities, and tell them that he had NOT battered or struck her in any way on September 8, 2015, as he was being charged with domestic battery for an incident that did not happen.

Shelley agreed, then hand wrote scribbled and signed the following exculpatory declaration, under penalty of perjury, on November 5, 2015.


But then sometime in 2016, Shelley cooked up a new twist on the story, and sought to retract her previous sworn statement, claiming that it had been "coerced" by Garrett and his attorney. 

It is unknown whether the "impact statement" quoted within the following document was signed under penalty of perjury, and in fact it seems unlikely.

The projection in the second-to-last sentence is hard to ignore; it reads like it could have been written about Shelley herself. 

And the irony of Shelley Lubben complaining that someone else wrote or re-wrote a statement in her name is spectacular: many adult film stars, ex-performers, and even members of her own family, have long maintained that the so-called 'testimonies' purportedly written by them, and published by Shelley on her websites along with a plea for donations, have been doctored almost beyond recognition.

Shelley is accusing Garrett of the crime of bribery. Note, then, that Shelley's assertion that Garrett promised to pay off all of her bills through May appears to be contradicted by their contemporaneous Settlement Of Issues In Dissolution Of Marriage Case, upon which a judge signed off on June 9, 2016. (See the document here; http://thedevilandshelleylubben.blogspot.com/2016/08/shelley-lubben-evades-restraining-order.html ) And only after the fact did she realize that accepting hundreds of thousands of dollars worth of goods and real property in lieu of alimony would mean she'd have to get a job or else sell assets?

As the next court date, August 18, looms, it appears that both sides are steeling themselves for a battle royale. It falls upon Garrett to discredit Shelley, which should not be all that difficult, considering the potential witnesses who are lining up to testify -- as well as the fact that she claims she lied in her sworn declaration, and that she did so, essentially, for money.

UPDATE - Nov. 1, 2016:

Both Shelley Lubben and a local sheriff are scheduled to testify before a judge on December 5, 2016, and Mr. Lubben's attorney will have an opportunity to examine them.

Bakersfield, Calif - In the wake of a shocking sex scandal, the 21-year-long marriage of Garrett and Shelley Lubben has come to an inglorious end. 

In a Bakersfield hearing room on June 9, 2016, Judge John L. Fielder laid it all to rest.

Both parties waived their full declarations of disclosure (including their net worth and source/location of assets).






Next month, on July 19 at 10 a.m. Garrett will be back in court, this time in Porterville, Calif., for a Jury Trial setting in his September 2015 DV case, and a Jury Trial Confirmation in his October  2015 resisting arrest case. Charges in both of these odd cases were filed by his now ex-wife, the disgraced Shelley Lubben.

Court Dates For Shelley Lubben's Husband Pushed to July

Porterville, Calif. -- In Tulare County Superior Court  Tues. April 12, 2016, new court dates were set in the suspicious ongoing criminal cases against Garrett Lubben, husband of his disgraced accuser, Shelley Lubben, and co-founder of the anti-porn outfit, Pink Cross Foundation.

In 2015, Garrett, 43, and Shelley Lubben, 47, put their Bakersfield McMansion up for sale and Shelley moved way out in the country, to Springville, in California's Tulare County, while Garrett remained in Bakersfield so that the couple's youngest daughter wouldn't have to change schools.
As Pink Cross Foundation was continually exposed by Michael Whiteacre and others, the Lubbens downsized and lowered their profile, but trouble still followed them.

On September 8, 2015, the straight-laced Garrett, who was recently ordained and joined his wife in ministry, was arrested by Tulare County Sheriffs at the Lubbens' new home for domestic violence, and charged with Infliction of Corporal Injury on a Spouse/Cohabitant -- a charge which is notably out of character for the notably even-tempered businessman.

He bailed out the following day.
Then on October 8 of last year, the Tulare County Sheriffs were dispatched once again to the Lubben homestead, and Garrett, was carted off again with a fresh set of charges: disobeying a court order (regarding the Sept 8 domestic violence charge), and resisting arrest.


His bond was initially set at $50,000. That’s a substantial bond.

On December 1, the Tulare County D.A.'s office opted to prosecute the new charges as well.

The need for cash might help explain why the couple had been so eager to sell their previous home in Bakersfield at a discounted price (they finally sold it in December).

But, it appears, the story is a bit more complex.

As revealed here last month, in 2015 Shelley had allegedly begun a fling with her "ranch foreman", a former dishwasher from Bakersfield named Joseph Valley (then age 26).

But then Shelley phoned in a domestic violence case on him, too!

Valley, aged 27, was arrested by Tulare County Sheriffs early on Christmas morning, 2015. His bail was set at $50,000, which he was unable to pay.

Valley was convicted and sentenced, and eventually released on March 22, 2016

All of which causes one to wonder, did Garrett walk in on something back in September or October of last year?

Bear in mind, on Oct. 13, 2015, five days after being arrested a second time at Shelley's "Ranch", Garrett filed for a legal separation in Bakersfield.

On March 14, Garrett amended his petition to Dissolution of Marriage (divorce), and on March 24
proof was filed in Bakersfield that Shelley had been served with Garrett's divorce papers.

On Tuesday, Jan. 12, Garrett Lubben had been ordered to appear in Porterville for arraignment on the charge of Obstructing/Resisting a Public Officer in violation of California Penal Code 148(a)(1). That case # is PCM327330
On Jan. 26, an attorney appeared on Garrett's behalf, and a Feb. 29 hearing date was set in both criminal cases.

At the February hearing, a date for trial setting was ordered for April 12, with a tentative Trial by Jury scheduled for April 14.

Tuesday, a new court date of July 19 at 10 a.m. was set in both of his cases: a Jury Trial setting in the September DV case, and a Jury Trial Confirmation in the October resisting arrest case.

At the time he met Shelley, in the 1990s, she was a heavy partier and he was using and selling methamphetamine in and around Chino, Calif. Beginning with a stint in the U.S. Army, he turned his life around and became a successful businessman and devoted father.

Lubben’s father Glenn, now deceased, had reportedly also been a pastor, but “fell to sexual sin”, Shelley has said.

Porterville, Calif. -- In Tulare County Superior Court  Monday Feb. 29, 2016, trial dates were set in the ongoing criminal cases against Garrett Lubben, husband of Shelley Lubben and co-founder of the anti-porn outfit, Pink Cross Foundation.

Bench Warrant Ordered For Garrett Lubben After Failure To Appear at Arraignment

Porterville, Calif. -- In Tulare County Superior Court Tuesday, Jan. 12, 2016, Garrett Lubben, 43, was scheduled to be arraigned on criminal charges for the second time. Lubben is a businessman, and the co-founder, along with his disgraced wife Shelley Lubben, of the anti-porn group Pink Cross Foundation.

However, according to the court clerk, Mr. Lubben failed to appear in court on Tuesday, and a Bench Warrant was ordered by the court.

Speaking as a critic of the Lubbens, it’s actually hard to imagine Garrett doing such a thing. And don't forget, for almost a decade we’ve heard Shelley refer to him as “Mr. Wonderful” and “a godly man”.  Even when he covered up for Shelley, he was even-tempered, as this video shows:

On December 1, the Tulare County D.A.'s office opted to prosecute these bizarre new charges as well.

On September 8, 2015, Garrett, who was recently ordained and joined his wife in ministry, was taken into custody at their new home following Shelley's claim of domestic violence, and charged with Infliction of Corporal Injury on a Spouse/Cohabitant. He bailed out the following day.
Even as a critic of the Lubbens, it’s hard to imagine the even-tempred Garrett Lubben I've met doing such a thing. Also, for years we’ve heard Shelley refer to him as “Mr. Wonderful” and “a godly man”. He was certainly willing to dutifully back (and enable) her all these years:
